1. About these Terms

These Online Consultation Terms apply to any video, telephone or other remote consultation session that we make available through our website, booking platform or related online systems (each, an Online Consultation).

By booking, attending or paying for an Online Consultation, you agree to these Online Consultation Terms and our General Online Terms and Conditions published on our Site. If there is any inconsistency between these Online Consultation Terms and our General Online Terms and Conditions, these Online Consultation Terms prevail to the extent of the inconsistency in relation to the Online Consultation.

In these Online Consultation Terms, unless the context requires otherwise:

  • Client Relations Team means our non-legal administrative and client support staff;
  • Migration Coordinator means a member of our team who assists with nurse registration and related coordination matters;
  • Online Services means our website, booking platform, and related online systems;
  • Site means our website at solvi.com.au and its subdomains;
  • we, us or our means SOLVi Pty Ltd ABN 16 658 861 182; and
  • you or your means the person booking, attending or paying for an Online Consultation.

2. Nature of Online Consultations

Online Consultations are limited-scope sessions delivered remotely by video, telephone or another communication method chosen by us.

An Online Consultation is not an open-ended engagement. It is limited to the consultation type booked, the time allocated, and the information and documents made available to us before or during the session.

An Online Consultation does not create an ongoing retainer. Unless expressly agreed otherwise in writing, we are not obliged to provide further work, follow-up advice, document preparation, representation, lodgement services, or ongoing support after the session ends.

3. Types of Online Consultations

3.1 Discovery Calls

A Discovery Call is a short introductory session conducted by a member of our Client Relations Team. The purpose of a Discovery Call may include:

  • discussing your circumstances and goals;
  • gathering initial information;
  • considering suitability;
  • discussing process and administrative next steps; and
  • considering whether we can assist.

A Discovery Call is not a legal consultation or migration advice appointment. During a Discovery Call, we will not provide legal advice, migration advice, a definitive eligibility assessment, a strategy recommendation, or a binding fee quote.

3.2 Guidance Calls

A Guidance Call is a session conducted by a member of our Client Relations Team based on a documentary assessment already prepared by our lawyers. The purpose of a Guidance Call may include:

  • explaining the outcome of the assessment;
  • discussing process, next steps and service options; and
  • providing administrative and cost information.

A Guidance Call is limited to explaining an existing assessment. The written assessment prevails over any verbal statements made during the call.

3.3 Nurse Registration Consultations

A Nurse Registration Consultation is conducted by a Migration Coordinator based on a documentary assessment. The session may include:

  • explaining the likely registration pathway;
  • discussing process requirements; and
  • outlining matters from the assessment.

The person conducting a Nurse Registration Consultation is not acting as a lawyer or registered migration agent unless expressly stated otherwise.

3.4 Legal Consultations

A Legal Consultation is conducted by a lawyer or registered migration agent. The session may include:

  • identifying legal or regulatory issues;
  • discussing options;
  • providing legal information or migration advice;
  • discussing next steps; and
  • considering further engagement.

Advice provided during a Legal Consultation is limited to the information and documents available at the time and the scope of the session booked.

4. Scope Limitation

Each Online Consultation is strictly limited to one matter per session unless expressly agreed otherwise. This means:

  • one person's migration or citizenship enquiry;
  • one person's nurse registration matter; or
  • one sponsorship matter for one business or worker.

You must not use one consultation to address multiple people, matters or strategies unless expressly included in the booking. Additional matters may require a further consultation.

5. Booking and Appointment Confirmation

A booking is confirmed once:

  • we accept the booking;
  • payment has been made; and
  • you have received a confirmation.

You are responsible for checking the details of your booking and saving the appointment to your calendar.

We may decline, require rescheduling, or refuse to proceed with a booking where:

  • there is a conflict of interest;
  • the booking information is incomplete or inaccurate;
  • the matter is outside the scope of the consultation type booked;
  • the wrong consultation type has been booked;
  • we cannot verify your identity; or
  • we are reasonably unable to provide the consultation.

6. Fees and Payment

The fee for an Online Consultation must be paid in full before the consultation unless otherwise agreed in writing.

The fee is for the specific consultation booked only. It does not include:

  • ongoing legal or migration work;
  • document review beyond the session;
  • written advice after the consultation;
  • representation, lodgement or correspondence; or
  • follow-up calls or emails.

All fees are in Australian dollars (AUD) and inclusive of GST unless stated otherwise.

7. Cancellation, Rescheduling and No-Show Policy

You may reschedule or cancel a consultation with at least 24 hours' notice before the scheduled time.

  • With 24+ hours' notice: We may reschedule the consultation or provide a credit (to be used within 30 days).
  • Less than 24 hours' notice, no-show, or not ready within 10 minutes: The session is forfeited and no refund will be provided.

Any rescheduled session is subject to availability and must be booked within 30 days of the original appointment.

8. Provider Rescheduling and Cancellation

We may reschedule a consultation where reasonably necessary, including due to illness, unavailability, conflicts of interest, technical issues, or the need to assign more suitable personnel.

If we cancel a consultation and cannot provide a replacement, we will reschedule at no additional cost or provide a refund.

If a technical issue on our side affects the session, we may continue by another method, reschedule the balance of the session, or provide a credit or refund.

9. Strictly Limited Refund Rights

Fees for Online Consultations are generally non-refundable once the booking has been made and payment received.

No refund will be provided for:

  • change of mind;
  • failure to attend the consultation;
  • late cancellation;
  • failure to provide information or documents;
  • deciding not to proceed after the consultation; or
  • dissatisfaction with an assessment or advice that was properly given.

Nothing in this clause excludes rights you may have under the Australian Consumer Law.

10. Your Information and Documents

You are responsible for the accuracy, completeness and currency of all information and documents you provide to us.

You must promptly tell us of any material changes to your circumstances that may affect the consultation or any advice provided.

We may rely on the information you provide without independently verifying it. Any advice or assessment is based only on the information and documents available at the time of the consultation.

We are not liable for any loss arising from:

  • inaccurate, incomplete, outdated or misleading information provided by you;
  • your failure to provide material information in a timely manner; or
  • undisclosed changes in your circumstances.

11. No Guarantee of Outcome

We do not guarantee that:

  • any application will be approved;
  • a particular outcome will be achieved;
  • you are eligible for any visa, registration or other benefit; or
  • the consultation will be sufficient without further work.

Any comments about likely outcomes are opinions only and are not guarantees.

12. Online Delivery, Technology and Session Conduct

You are responsible for ensuring you have:

  • a working internet connection or telephone;
  • a suitable device and software;
  • a private environment; and
  • sufficient time for the consultation.

We are not responsible for delays, dropouts or poor quality caused by your equipment, internet connection, environment or third-party platforms.

If you attend late, the consultation may still end at the scheduled time.

We may suspend, end or refuse to continue a consultation if there is:

  • abusive, threatening or discriminatory behaviour;
  • suspected fraud or impersonation;
  • a safety, legal or regulatory concern; or
  • the booking is unsuitable for the issue presented.

13. Identity Verification and Authority

We may require you to verify your identity before or during a consultation.

If you are booking on behalf of a business, employer or another person, you confirm that you have the authority to do so.

We may refuse to discuss confidential information where we are not satisfied as to your identity, authority or consent.

14. Recordings and Notes

We may make file notes of consultations for internal record-keeping, compliance, training and service purposes.

We will not record audio or video of a consultation unless we notify you and your consent is obtained.

You must not record any consultation without our prior written consent.

15. Privacy and Confidentiality

We collect, use and disclose personal information in accordance with our Privacy Policy and applicable law.

By booking an Online Consultation, you consent to the collection and use of your personal information for the purposes of:

  • arranging and conducting the consultation;
  • assessing how we may assist you;
  • complying with legal and regulatory obligations; and
  • providing related services.

Electronic communications involve inherent risks and may not be completely secure.

Our duty of confidentiality is subject to applicable law, court orders, regulatory obligations and our rights.

16. No Ongoing Engagement

Unless expressly agreed in writing, we are not retained to:

  • monitor deadlines;
  • update advice;
  • prepare or lodge applications;
  • contact third parties on your behalf;
  • review further documents; or
  • take any further step after the consultation ends.

Any ongoing work is subject to a separate engagement and costs agreement.

17. Limitation of Liability

To the maximum extent permitted by law:

  • Online Consultations are provided for the limited purpose described in these terms;
  • we exclude liability for indirect, consequential, special or incidental loss; and
  • our aggregate liability is limited to the amount paid for the relevant consultation.

Nothing in this clause excludes, restricts or limits liability for rights that cannot lawfully be excluded.

Where the law implies a guarantee and permits limitation, our liability is limited to resupplying the services or paying the cost of having the services resupplied.

18. Right to Refuse Services

We may decline to provide an Online Consultation where:

  • there is a conflict of interest;
  • the matter is outside our expertise or scope;
  • the booking was made on a false or misleading basis;
  • required checks have not been completed;
  • fees remain unpaid; or
  • continuing would expose us to legal, regulatory, ethical or reputational risk.

19. Changes to Bookings or Consultation Type

If the issue you present differs materially from the consultation type booked, we may:

  • limit the session to the scope of the consultation type booked;
  • require a further or different consultation; or
  • end the session and invite you to rebook under the appropriate consultation type.

Additional time or services will be charged separately unless otherwise agreed.

20. General

  • If any provision of these Online Consultation Terms is invalid, it will be severed and the remaining provisions will continue in full force and effect.
  • A failure or delay in exercising a right does not operate as a waiver of that right.
  • These Online Consultation Terms are governed by the laws of Queensland, Australia. You submit to the non-exclusive jurisdiction of the courts of Queensland.
  • We may update these terms by publishing the updated version on our Site. The version in force at the time of your booking applies to that booking.
  • These Online Consultation Terms, together with your booking confirmation, any costs disclosure, engagement terms, and our General Online Terms and Conditions, form the entire agreement between you and us in relation to the Online Consultation.
